These Terms constitute a legally binding agreement between you and SponsorRacecars.com. We reserve the right to modify these Terms at any time, and your continued use of the Platform following any changes indicates your acceptance of the modified Terms.

2. User Accounts and Registration

2.1 Account Types

Our Platform offers two types of user accounts:

• Driver Accounts: For racing drivers seeking sponsorship opportunities
• Sponsor Accounts: For companies and individuals looking to sponsor racing drivers

2.2 Account Responsibilities

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• You must be at least 18 years old to create an account

3. Membership and Subscriptions

3.1 Driver Memberships

Driver memberships provide access to profile creation, visibility in sponsor searches, and communication features. Membership tiers include Rookie, Pro, and Champion, each with different features and pricing.

3.2 Sponsor Memberships

Sponsor memberships provide access to driver search features, messaging capabilities, and promotional opportunities. Membership tiers include Basic, Premium, and Elite.

3.3 Payment and Billing

• All fees are non-refundable unless otherwise stated
• Memberships automatically renew unless cancelled before the renewal date
• We reserve the right to modify membership pricing with 30 days notice
• Failed payments may result in suspension or termination of your account

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of all content you post on the Platform, including profiles, photos, videos, and communications. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

4.2 Content Restrictions

You agree not to post content that:

• Is false, misleading, or fraudulent
• Infringes on intellectual property rights of others
• Contains viruses, malware, or harmful code
• Is defamatory, obscene, or offensive
• Violates any applicable laws or regulations
• Promotes illegal activities or violence

4.3 Platform Content

All Platform content, including logos, trademarks, design, text, and software, is owned by SponsorRacecars.com or our licensors and is protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5. Sponsorship Agreements

Important Notice: SponsorRacecars.com is a platform that facilitates connections between drivers and sponsors. We are not a party to any sponsorship agreements made between users.

• All sponsorship negotiations and agreements are solely between drivers and sponsors
• We do not guarantee that drivers will find sponsors or that sponsors will find suitable drivers
• We are not responsible for the performance, conduct, or obligations of any users
• Users should conduct their own due diligence before entering into any agreements
• We recommend all sponsorship agreements be documented in writing

6. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose
• Impersonate any person or entity
• Harass, threaten, or intimidate other users
• Collect or store personal information of other users without consent
• Attempt to gain unauthorized access to the Platform or user accounts
• Interfere with or disrupt the Platform's functionality
• Use automated systems (bots, scrapers) without permission
• Engage in fraudulent activities or scams
• Post spam or unsolicited commercial messages
• Circumvent any security features or access controls

7. Communications and Messaging

Our Platform provides messaging features to facilitate communication between drivers and sponsors. By using these features, you agree that:

• All communications must be professional and respectful
• We may monitor communications to ensure compliance with these Terms
• We reserve the right to remove or restrict access to messages that violate our policies
• You should not share sensitive financial information through our messaging system

8. Promotional Codes and Offers

Sponsors may create promotional codes for the racing community. By creating or using promotional codes:

• Sponsors are responsible for honoring all promotional offers they create
• SponsorRacecars.com is not responsible for disputes regarding promotional codes
• Promotional codes may be subject to terms and conditions set by the sponsor
• We reserve the right to remove promotional codes that are fraudulent or misleading
• Expired promotional codes will be automatically deactivated

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your personal information. By using the Platform, you consent to our collection and use of your information as described in our Privacy Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF USER CONTENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR ANY DAMAGES ARISING FROM SPONSORSHIP AGREEMENTS
• WE ARE NOT LIABLE FOR INTERRUPTIONS, ERRORS, OR SECURITY BREACHES

11. Indemnification

You agree to indemnify, defend, and hold harmless SponsorRacecars.com, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

12. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of membership fees
• Prolonged inactivity
• Requests from law enforcement

Upon termination, your right to use the Platform will immediately cease. You may also terminate your account at any time through your account settings.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13.2 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except for disputes that may be brought in small claims court. You waive your right to participate in class action lawsuits or class-wide arbitration.

14. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Platform.

15. Third-Party Links and Services

The Platform may contain links to third-party websites, services, or advertisements. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.

16. Partner Designations

Use of the terms "Partner", "Brand Partner", "Platform Partner", "Featured Partner", or any similar designation refers solely to a marketing or promotional relationship and does not imply any legal partnership, joint venture, agency, fiduciary relationship, or ownership interest in SponsorRacecars.com.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SponsorRacecars.com regarding your use of the Platform and supersede all prior agreements and understandings.
